PHILLIPS, Circuit Judge.

A proceeding under § 74 of the Bankruptcy Act, 11 U.S.C.A. § 202, was pending in the District Court of the United States for the District of Kansas, No. 4634 in Bankruptcy.

On June 7, 1939, Jesse D.
