The plaintiff, Walter E. Miller, brought an action in the circuit court of Piatt county against the defendants, Albert Miller and the Illinois Central Railroad Company, to recover damages for personal injuries sustained in a collision on September 29, 1942, between a tractor-trailer truck, owned and driven by his brother, Albert Miller, and a train owned and operated by the railroad company.
