OPINION

KAUFFMAN, Justice.

On February 24, 1976, appellant, Robert Stamps, was arrested and charged with possession and possession with intent to deliver a controlled substance.1 A search, pursuant to warrant, had uncovered twenty-five (25) packets of heroin in appellant’s apartment. A timely motion to suppress the *533evidence was filed, but after a hearing, denied. On October 29, 1976, appellant was tried without a jury and convicted on both charges.
