COMPTON, Chief Justice.

This appeal is from a judgment of the District Court of Bernalillo County in awarding damages of $7,000.00 to the plaintiff for alleged latent defects in a new house he and his wife had purchased from the defendant.

The plaintiff sought damages for breach of express and implied warranties to repair, for failure to reveal latent defects in the foundation of the house and in the soil on which the foundation rested, or for a rescission of the sale and return of the purchase price of $27,500.00.
