NOBLE, Justice.

This is a second appeal from a judgment entered in two consolidated cases upon a settlement and compromise of the matters in dispute.

Mrs. Bogle filed two suits: one in her individual capacity against Mr. Potter and the Potter Company, a corporation; and the other by the Potter Company, by Mrs. Potter, individually and ás a stockholder, against Mr. Potter.
