Defendant moves to dismiss the complaint for legal insufficiency, pursuant to rule 106 of the Buies of Civil Practice or, in the alternative: (1) for an order, under rule 102 of the Buies of Civil Practice, requiring the plaintiff to make the complaint more definite and certain with respect to paragraph “ Thirty-ninth ” of the complaint, and (2) to require the service of an amended complaint pursuant to rule 90 of the Buies of Civil Practice which will separately state and number the causes of action stated in the complaint.
