EGINTON, Senior District Judge.
Pursuant to Rule 12(b)(6), Fed.R.Civ.P., defendant, New Haven Register, has moved to dismiss counts seven and eleven of plaintiffs complaint for failure to state a claim upon which relief may be granted [Doc. # 7]. Plaintiff responded to this mo tion by filing an amended complaint with additional factual allegations, which defendant has addressed in its reply memorandum.
