1. action was brought by appellee to recover damages for a personal injury received while in appellant’s employ. The appeal was taken directly to this court upon the claim that a constitutional question is involved and presented by the record for decision. The action is founded upon section one of the employers’ liability act (Acts 1893, p. 294, §7083 Burns 1901). The validity of this act, so far as it applies to railroads, was upheld in the case of Pittsburgh, etc., B. Co. v. Montgomery (1898), 152 Ind. 1, 69 L. R. A. 875, 71 Am.
