This cause has been transferred here because the Appellate Court was equally divided on the questions involved. Davis Coal Co. v. Polland, 27 Ind. App. 697.

Appellee had judgment against appellant for damages for personal injuries. The assignments are that the court erred *609in overruling appellant’s demurrer to the complaint, motion for judgment on the jury’s answers to interrogatories notwithstanding the general verdict, and motion for a new trial.
