MEMORANDUM AND ORDER
SAFFELS, District Judge.
This matter is before the court on defendant’s Motion for Summary Judgment (Doc. 34). Both parties have filed briefs on this issue and the court is ready to rule.
I. FACTUAL BACKGROUND
The plaintiff initiated this case seeking overtime wages he claims he is entitled to under the Kansas Minimum Wage and Maximum Hours Law (“KMWMHL”), Kan.Stat.Ann. § 44-1204(a) and for a statutory penalty under the Kansas Wage Payment Statute, Kan.Stat.Ann. § 44-315(b).
