Now before the Court are Defendant’s motions to dismiss under Fed.R.Civ.P. 12(b)(6), failure to state a claim upon which relief can be granted. Plaintiffs assert causes of action under theories of fraud, breach of contract, and the Kansas Consumer Protection Act (KCPA). Subject matter jurisdiction under 28 U.S.C. § 1332(a) is not disputed.
