Pending before the court is the Housing Authority of the City of Port Arthur, Texas, (the “Housing Authority”) and Seledenio Quesada’s (“Quesada”) (collectively “Defendants”) Motion to Dismiss (# 5). Defendants move for dismissal of Plaintiff Berlinsia Gallentine’s (“Gallentine”) claims for discrimination and retaliation under Title VII, § 1981, and § 1983 on the ground that they are legally and factually infirm.
