PER CURIAM: This case comes before the court on plaintiffs request pursuant to Rule 54(b) for review of the recommended decision of Trial Judge Philip R. Miller, filed January 29, 1979. The case has been submitted to the court on the briefs and oral argument of counsel. Since the court agrees with the trial judge’s recommended decision and conclusion of law, as modified by the court, it hereby affirms and adopts the same, as modified, as the basis for its action in the case.
