This was an action for a trespass committed by defendant, a contracting corporation, by tearing down without right the wall of a store occupied by the plaintiff as lessee.

The cause was tried to the jury, and plaintiff claimed to have proved a lease of the store from one Esidor Derecktor, the owner of the building; that the defendant, without right or permission, tore down the partition wall on the west side thereof, running practically the whole length of the store, and left the whole side of the store on the western side exposed to the weather, dust, dirt and such conditions as would result…
