It appears that Henry Godfrey, in December, 1852, as deputy sheriff under the orator, Chamberlin, collected an execution in favor of John Bradley against Daniel Tarble, Jr., amounting to $1850.88 and deposited the funds in the South Royalton Bank, but did not return the execution nor pay over the money to Bradley. Bradley in 1854 sued Chamberlin for Godfrey’s laches, and notice of the suit was given to Godfrey, who took the defence of it upon himself and such proceedings were had therein that Bradley, in 1859, recovered judgment against…
