WALDMAN, District Judge.

I. Background

Presently before the court are defendants’ motions for summary judgment in this 42 U.S.C. § 1983 case. Plaintiff alleges that his First, Fourth, Fifth, Eighth and Fourteenth Amendment equal protection rights were violated when Chalfont Borough police charged him with sexually abusing a young retarded woman in his care without probable cause, and when the Bucks County District Attorney’s Office did not promptly dismiss the charges.
