McCLURE, District Judge.

BACKGROUND

Plaintiff Charles E. Shoemaker alleges in this section 1983 action 1 that his removal as Chief of Police of the City of Lock Haven, Pennsylvania (Lock Haven or the city) was a violation of his civil rights.

Plaintiff was promoted to the position of Chief of Police on a probationary basis on December 6, 1993. He signed an “Employment Agreement” with the city which provided that: 1) he would be employed by the city as Chief of Police until January 1, 1996; 2) he would complete a six-month probationary period during which time he could be removed from…
