This case arises from a decision by the Public Health Service (“PHS”) to terminate Mary Verbeck, a nurse practitioner, during her probationary period of employment. Prior to her termination, Ms. Verbeck had attained the rank of Lieutenant Commander with the PHS’ Commissioned Corps.
