This case arises from a decision by the Public Health Service (“PHS”) to terminate Mary Verbeck, a nurse practitioner who served as a Lieutenant Commander in PHS’ Commissioned Corps, during her probationary period of employment. Previously, the court had considered, vacated, and remanded a decision by the Board for Correction of PHS’ Commissioned Corps Records (“Board”), which had denied Ms. Verbeck’s *446application to rescind her discharge.
