Plaintiff brought this action to quiet title to certain described lands situated in Richland county, his complaint being in the usual form. James Hardy, son of W. A. Hardy, is the only defendant who appeared in the action and he will hereafter be referred to as the defendant. By answer he alleged that on May 24, 1921, W. A. Hardy was the owner of the lands in question and on that day he gave a mortgage on it to A. B.
