Alexander, J.
Defendant appeals his conviction, by jury verdict, of second degree murder (Penal Law § 125.25 [1]) and fourth degree criminal possession of a weapon (Penal Law § 265.01). He contends that his statement made during a psychiatric examination pursuant to CPL 330.20 (11) in which he confessed to the murder, had been hypnotically induced and thus was improperly received in evidence against him.
