This matter is before the Court on the defendant’s motion to dismiss pursuant to Rules 12(b)(1) and 12(b)(6) or, alternatively, for summary judgment pursuant to Rule 56(c) of the Federal Rules of Civil Procedure (collectively, the “Def.’s Mot.”). 1 The plaintiff, Stacey K.
