We find the trial court abused its discretion in denying appellants’ motion under Code of Civil Procedure 1 section 473 (“The court may . . . relieve a party . . . from a[n] . . . order . . . taken against him . . . through his . . . mistake, inadvertence, surprise or excusable neglect.”).
