BACKGROUND

Plaintiff Hendricks Music Company (“Hendricks”) brought this action against defendant Steinway, Inc. (“Steinway”) alleging that Steinway’s conduct in seeking to terminate Hendricks’ Steinway dealership because of Hendricks’ agreement to handle the concert and artist (“C & A”) program of Yamaha Music Corporation (“Yamaha”) constitutes an exclusive dealing agreement, in violation of Section 3 of the Clayton Act, 15 U.S.C. § 14, and Section 1 of the Sherman Act, 15 U.S.C. § 1, as well as monopolization in violation of Section 2 of the…
