MÓURSUND, J.

This is a suit for damages for personal injuries sustained by ap-pellee, a switchman in the employ of appellant The trial resulted in a verdict and judgment for plaintiff. As no contentions arise in regard to the pleadings, the nature of the issues made thereby will be sufficiently disclosed by a statement of the substance of the findings made by the jury in answer to special issues, in addition to their finding of the amount of damages suffered by plaintiff, as follows: That on the night of the accident to plaintiff and just prior thereto the foreman of the switching crew…
