Defendant in error, Branton, was plaintiff in the trial court, and plaintiff in error was defendant. We shall refer to them as plaintiff and defendant.

Plaintiff brought this suit against the defendant to recover under the Workmen’s Compensation Law of Texas (Vernon’s Ann. Civ. St. art. 8306 et seq.). He alleged: That on September 19, 1931, he sustained serious personal injuries of a permanent nature, while in the course of his employmént as an employee of the Welding Engineering Company of Mar-tindale, Okl., in Nacogdoches county, Tex.
