RAY, District Judge.

The patent in suit, No. 692,277, for “incubator,” was granted to Wilber P. Hall, of Pembroke, N. Y., February 4, 1902, and the claim reads as follows:

“In combination with an incubator, a heater, having a water jacket, pipes within the incubator having communication with said water jacket, the upper end of the heater having an air chandler, a throttle mounted over an aperture leading into said chamber, a stem to said, throttle passing through an aperture in the upper wall of said chamber, an expansion, cylinder, a float mounted therein, said expansion cylinder having…
