Borg-Warner Insurance Finance Corporation (“BWIFC”) seeks a determination that it has a valid, perfected, and enforceable security interest in a $133,919.00 escrow fund, created pursuant to the order of this court in recognition of the fact that unearned premiums from the insurance policies BWIFC financed for RBS Industries, Inc. (“RBS”) and claimed by BWIFC to be collateral for such financing, were diminishing on a daily basis. See…
