MANTON, Circuit Judge.
The appellee now owns, by assignment, letters patent No. 737,179, granted August 25, 1903, for a screwdriver, and design letters patent No. 37,214, of November 8, 1904, for a design for the screwdriver. Both were issued to William S. Ward. The mechanical patent was considered by this court in an action wherein the present appellee was plaintiff and the Southington Manufacturing Company was defendant. 247 Fed. 342, 159 C. C. A. 436.
