OPINION

MARGOLIS, Judge.

In this action for breach of contract and taking of property without just compensation, plaintiff Alaska Pulp Corporation’s (“APC”) fifth claim for relief requests that this Court determine the parties’ rights under a land patent. Pursuant to RCFC 12(b)(1), Defendant requests that this Court dismiss the fifth claim of APC’s first amended complaint for lack of subject matter jurisdiction.
