OPINION

BUSH, Judge.

This matter, before this court on the defendant’s motion to dismiss, involves a power sales contract between Bonneville Power Administration (Bonneville or BPA) and Vanal-co, Inc. (Vanalco). In this litigation, plaintiff Vanalco alleges BPA’s failure to offer it the same amendments as it did to other utilities constitutes a breach of contract and breach of the implied covenant of good faith and fan-dealing. On August 8, 2000, Vanalco moved for expedited proceedings to resolve the issue of subject matter jurisdiction. The court agreed to implement an expedited schedule. On…
