-On the 1st day of March, 1864, the appellant brought suit against Asher Norton for the recovery of certain real estate situate in Terre Haute. At the March term, 1865, the appellant asked and obtained leave to amend her complaint by making Sophia Smith a defendant. The amendment was made and process was ordered, returnable at the next term. Whether Horace B. Smith, who was also a defendant, was named in the original complaint or was brought in afterwards, does not appear from the record.
