Order, Supreme Court, New York County (Herbert Adlerberg, J.), entered on or about May 31, 1996, which granted defendant’s motion to dismiss the indictment charging him with criminal sale of a controlled substance in the third degree and criminal possession of a controlled substance in the third degree pursuant to CPL 30.30, unanimously reversed, on the law, the motion denied and the indictment reinstated.
