TANG, Circuit Judge:
Pyrodyne appeals the district court’s denial of its motion for preliminary injunction to order Pyrotronics to cease infringing Pyrodyne’s trade name, Red Devil Fireworks, in Washington, Oregon, Alaska, Northern Idaho and Montana. Pyrotron-ics, in turn, appeals the district court’s denial of its motion for preliminary injunction in the same action. The dispute concerns ownership of and rights to the name “Red Devil” as used in connection with the sale of fireworks. Pyrotronics owns an incontestable trademark in the name Red Devil.
