I. INTRODUCTION AND PROCEDURAL HISTORY

On January 29, 1996, the plaintiffs filed this action in the Circuit Court for Autauga County, Alabama against Transouth Financial Corporation (Transouth) and Associates Insurance Company (Associates) alleging that the defendants’ policy of charging excessive amounts for collateral protection insurance (CPI) violates various provisions of state law.
