This action was commenced by the plaintiff, to recover damages in the sum of $2,995, for personal injuries alleged to have been sustained, and damages to an automobile, resulting from a collision between an automobile driven by the plaintiff with a locomotive and coal car being operated by the defendant railway company. There was judgment for the plaintiff for the amount sued for, and the defendant has appealed to this court, and complains of the giving of instruction No. 2 by the court over its exception, and the refusal of the court to give to the jury instruction No.…
