MEMORANDUM OPINION
WALTON, District Judge.
Luis Martinez (“the plaintiff’) brings this diversity action against Hartford Casualty Insurance Company (“Hartford” or “the defendant”), alleging that the defendant acted in bad faith by failing fully to comply with the terms of the plaintiffs insurance policy when compensating the plaintiff for losses arising out of a fire that destroyed the plaintiffs rental property in July 2001.
