MEMORANDUM OPINION

PAUL L. FRIEDMAN, District Judge.

This matter is before the Court on defendant’s motion to dismiss plaintiffs complaint pursuant to Rules 12(b)(5) and 12(b)(6) of the Federal Rules of Civil Procedure.1 Upon consideration of the entire record in this case, the Court will dismiss plaintiffs complaint without prejudice for insufficient service of process pursuant to Rule 12(b)(5).
