This is an action brpughjt by the defendant in error against the plaintiff in error, to recover damages for á malicious prosecution. The case was tried to a jury, and judgment rendered in favor of the plaintiff in the sum of $500. Timely motion was made for a new trial, which was overruled, excepted to, and error brought to this court.

Por convenience, the parties will hereinafter be referred to as they appeared in the trial court.
