On the first day of' July, 1921, L. R. Freeman, plaintiff, commenced this action in the district court of Oklahoma county against the Oklahoma Producing & Refining Corporation of America to recover $40,000 damages alleged to have been “Sustained by the plaintiff as a result of the negligence of the defendant.
