We issued our original memorandum opinion in this case on December 12, 2013. Appellants, John James Harkins et al. 1 (“Harkins”) and Dynamic Production, Inc. (“Dynamic”), filed motions for rehearing and for en banc reconsideration. See Tex. R.App, P. 49.1, 49.7.
