FINDINGS AND OPINION

POLLACK, District Judge.

Jurisdiction herein is based on diversity of citizenship and requisite amount in controversy.

This litigation results from a series of commercial transactions connected with the construction of a section of the Gowanus Expressway in Brooklyn, New York, hereafter called the “Gowanus Job”. What began as an innocent sale of structural steel by the plaintiff to the project, evolved into a very complex controversy that has festered and dragged on for more than a decade.
