THE COURT.

The controversy involved in this appeal arose out of the 'arrest of plaintiffs Prances Graham and Catherine Mary Graham, upon a criminal complaint sworn to by the defendants, charging them jointly with the theft of four head of cattle. They were taken into custody and later released upon the posting of bail in the sum of $1,000 each. At the conclusion of the preliminary hearing, at which plaintiffs did not testify, they were held to answer in the superior court.
