Appellee brought this action in the county court of Warren county against appellant to recover the sum of four hundred dollars, which appellee had theretofore paid to appellant, under protest, as a privilege license for conducting pleasure boat excursions from Vicksburg, and return, on the Mississippi river. A jury was waived, and the case tried before the county judge, who rendered a judgment in favor of appellee.
