Mr. Justice McKenna,
after making the above statement, delivered the opinion of the court.. -The statute excepts from its operation lands used for agricultural purposes if owned by individuals. It includes such lands if owned by corporations. It is hence contended by plaintiff in error, that the statute discriminates between the owners of agricultural lands, and between them again and the' owners of all other lands, and infringes thereby the provisions of the Constitution of the United States which guarantees to all persons the equal protection of the laws.
