Milton Griffin (hereafter referred to as “movant”) was charged with and convicted of two counts of first degree murder. § 565.020, RSMo 1986. After finding mov-ant guilty, the jury assessed movant’s punishment in Count I at life imprisonment without eligibility for probation or parole. The jury was unable to agree on punishment in Count II. The trial court assessed that punishment at death. The convictions were affirmed on direct appeal. State v.
