This is an appeal from the judgment rendered in favor of respondent holding that the city did not have jurisdiction to proceed with the annexation of certain lands.

The Facts

In January 1961 the representatives of the corporate owners of property lying southeast of the City of Orange contacted certain officials of the city, namely, the city manager, director of public works and the city attorney, relative to annexation of this property to the City of Orange under the Annexation of Uninhabited Territory Act of 1939, Government Code section 35300.
