This action for damages for personal injuries, resulting from a collision between an automobile and a truck, resulted in a verdict by a jury in favor of respondent for $10,335.85, for which, after denying a new trial, the trial court entered judgment.

The negligence alleged by respondent to have been committed by appellant Shular, the agent, servant and employee of appellant Dairymen’s Association, consisted of driving the truck of appellant at a high, dangerous and unlawful rate of speed and over forty miles per hour; that the truck was driven and operated on the wrong side of the highway and…
