Plaintiff Sodexo Operations, LLC (“Sodexo”) brings this breach of contract action against Not-for-Profit Hospital Corporation (“NFP”) seeking damages arising from an alleged breach of contract between Sodexo and Capital Medical Center, LLC (“CMC”). NFP moves to dismiss the plaintiffs breach of contract claim under Federal Rule of Civil Procedure 12(b)(6) for failure to state a breach of contract claim against NFP and under Rule 8(a) for insufficient pleading.
