Plaintiff Sodexo Operations, LLC (“So-dexo”) brought a breach of contract action against Not-For-Profit Hospital Corporation (“NFP”), the purported successor-in-interest to the hospital operated by Capital Medical Center (“CMC”), seeking damages arising from an alleged breach of contract between Sodexo and CMC. Plaintiffs complaint was dismissed without prejudice for failure to state a claim pursuant to Federal Rule of Civil Procedure 12(b)(6).
